Measure 49 Information

We provide customized measure 49 assistance including:

  • Project Analysis
    Prior to starting work on a project, we will conduct research and provide you with a detailed analysis indicating possible solutions and an estimated timeframe to accomplish your goals. Although the state legislature has simplified the approval process for Measure 49 claimants who have selected the “express” option, the county government maintains control of the final processing of each Measure 49 claim, including the applicant's adherence to local and state regulations. An explanation of how this relates to your property and goals is explained in this step.
  • Supplementing your Measure 49 Election Forms
    If your situation has changed since you filed your Measure 49 election forms, you may need to re-analyze your options and make adjustments to your election background documentation. Possible changes may include, entering into a purchase and sale agreement on your Measure 49 property or adjacent properties, a change in ownership, a death in the family or other significant events. In addition to these considerations, there may be circumstances related to your claim that have not been properly explained to the state processing agency. Spending the time up front to clearly communicate your case can save you thousands and prevent a denial on your claim. We will evaluate your existing election form documents for completeness according to your unique situation.
  • Zoning Analysis and Maps
    Zoning can have a significant impact on your options with any land-use application. As part of our initial review, local zoning maps and their meanings will be reviewed with each claimant. Often by reviewing the underlying zoning, additional options can be uncovered that may provide benefit to the claimant. Measure 49 is only one tool that can be used to accomplish your goals. Other established techniques include, partitions, property tax deferrals, wildlife habitat deferrals, conditional use applications, special uses in conjunction with the underlying zoning and many more. We are experienced with most county zoning rules and through research we can uncover all of your options for your consideration.
  • Soil Analysis and Maps
    Soils classification is a key component to uncovering land-use options. The national registry of soils classifications holds a clue to your underlying soils type however it is not definitive. We can do additional analysis of your soils type and if necessary, we can hire professionals to expertly delineate and classify your soil as it relates to your land-use options. In addition, we will assess the possible interpretation of low or high value farmland as it is defined with Measure 49.
  • Site Visit
    A site visit can be the most important component to a successful land use application. Although zoning regulations can determine the possibilities, a site visit can uncover other options or restrictions that otherwise may go undiscovered. If we feel a site visit will be helpful, we will recommend it and schedule a time walk the property with you. During the site visit we can capture basic survey information including elevations, natural features, existing structures, dwellings, wells, septic sites, soils type, property boundaries, access, existing driveways, roadways and other pathways to be used with the final analysis and concept drawings. Unless the property is flat with very few features, we recommend a site visit.
  • Project Recommendation and Proposal
    For most projects we will make written analysis and recommendation for the development of your property. This recommendation may include a scaled drawing to further develop the concept. Upon review of this recommendation, it may also be beneficial to walk the property and install property stakes/flags to clearly show how the proposal will be reflected on the ground. Of course it is expected that the initial recommendation will be enhanced to further reflect the wishes of each client. We will continue to make changes until the client is 100% satisfied with the proposal.

  • Concept Drawings
    Once you are satisfied with the proposed solution, we will create a scaled drawing of the project including natural features, existing structures & improvements as well as proposed divisions and driveway accesses. This drawing should be reviewed by the client as it will eventually be included with the land-use application. (Ultimately a drawing will need to be created by a licensed surveyor so that it can be recorded with the county. The surveyed drawing will look much like the concept drawing however it will contain much more detail which is necessary for recording.)
  • Implementation
    The final application, burden-of-proof, irrigation maps, soils maps, drawings and all other required information will be assembled and submitted to the county for processing. County processing can take anywhere from weeks to several months to be completed. During this time we will maintain communication with the county to insure the project is moving ahead. Once approved, we will create a budget which details the costs for final plat recording (engineering and recording fees.) Our relationship with many local engineering offices assist us in getting the best pricing for our clients for final engineering and recording. Our clients report savings of several thousand of dollars by allowing us to coordinate this effort.
  • Full Service
    Many of our clients appreciate the type of full service we provide. Unlike an engineer who is only interested in the technical aspects of the project, we provide complete project management and oversight taking into consideration the property itself and all of your goals and aspirations, while also factoring in your lifestyle, timing and budgetary concerns.

    Land use projects generally involve a variety of resources including engineers, surveyors, attorneys, land planners, environmental experts, wildlife biologists, soils experts, excavators and construction crews. We will create a complete budget itemizing all costs prior to starting any work. After the budget is approved, we can oversee the entire project, providing updates to you on a regular basis. For each of our clients, we handle all communications with state and local agencies, coordinate all applications, and respond to requests for supplementary information. In addition, we react to changes in your situation as well as changes with state and local legislation. Your project becomes our top priority.

These options are provided to Measure 49 claim holders who are interested in the “Express” option. If the claimant is pursuing the “Conditional” or “Vested” option, we can tailor a program to suit these special needs. In some cases other professionals are contracted to perform specific tasks related to a land-use application. When this is the case, the client will be consulted and directed to sign a limited engagement contract with the firm providing the service. When necessary, these costs are included in the overall budget provided by Encore Properties, LLC.
